Biotech scan­dal drags on as the feds on­ly score par­tial vic­to­ry against ex­ecs charged with cook­ing the books

More than three years af­ter the SEC first charged for­mer ex­ec­u­tives of Osiris Ther­a­peu­tics for cook­ing the books, the le­gal saga still isn’t over just yet.

The feds had sought par­tial sum­ma­ry judg­ment — which would al­low them to skip tri­al and go straight in­to a ver­dict — against Lode De­bra­ban­dere and Philip Ja­co­by, who held the CEO and CFO posts, re­spec­tive­ly. While a Mary­land judge most­ly sided with them, he ruled that the SEC has not gone far enough to prove all the claims.
