J&J talc plain­tiffs pe­ti­tion fed­er­al court to block the phar­ma's 'Texas two-step' ma­neu­ver

Af­ter J&J se­cured a mas­sive win in bank­rupt­cy court ear­li­er this year, a fed­er­al court has agreed to re­view the de­ci­sion.

Plain­tiffs in a class ac­tion law­suit sued John­son & John­son over the com­pa­ny’s talc prod­ucts caus­ing can­cer — and some of those plain­tiffs plead­ed to an ap­pel­late court on Mon­day to re­vive their claims. A pan­el of the 3rd US Cir­cuit Court of Ap­peals out of Philadel­phia heard at­tor­neys’ ar­gu­ments that J&J sub­sidiary LTL Man­age­ment was “con­coct­ed” sole­ly for bank­rupt­cy.
