Ok­la­homa over­turns his­toric opi­oid de­ci­sion against J&J, wip­ing out $465M fine

The first court case to go to tri­al in­volv­ing a drug­mak­er’s role in the opi­oid epi­dem­ic, one that brought a his­toric de­ci­sion and fine against the in­dus­try, has been in­val­i­dat­ed.

Ok­la­homa’s Supreme Court struck down a 2019 rul­ing against J&J and over­turned a $465 mil­lion fine in an opin­ion de­liv­ered Tues­day, vot­ing 5-1 that a low­er court in­cor­rect­ly in­ter­pret­ed the state’s pub­lic nui­sance laws. Be­cause J&J had ap­pealed the pre­vi­ous rul­ing, none of the fine had been paid yet.
