Oklahoma overturns historic opioid decision against J&J, wiping out $465M fine
The first court case to go to trial involving a drugmaker’s role in the opioid epidemic, one that brought a historic decision and fine against the industry, has been invalidated.
Oklahoma’s Supreme Court struck down a 2019 ruling against J&J and overturned a $465 million fine in an opinion delivered Tuesday, voting 5-1 that a lower court incorrectly interpreted the state’s public nuisance laws. Because J&J had appealed the previous ruling, none of the fine had been paid yet.
