Pharma-backed patient groups sue HHS over copay assistance programs
Pharma-backed patient groups — including the HIV and Hepatitis Policy Institute, Diabetes Patient Advocacy Coalition, and Diabetes Leadership Council — are suing the HHS over what they see as its decision to side with insurers and PBMs, hitting patients’ pocketbooks when drugmakers’ copay coupons should be helping.
The HHS proposed a rule in 2020 related to certain copay accumulator adjustment programs, which are created by payers to prevent pharma-sponsored copay assistance from being counted towards a patient’s deductible or out-of-pocket maximum.
