Phar­ma-backed pa­tient groups sue HHS over co­pay as­sis­tance pro­grams

Phar­ma-backed pa­tient groups — in­clud­ing the HIV and He­pati­tis Pol­i­cy In­sti­tute, Di­a­betes Pa­tient Ad­vo­ca­cy Coali­tion, and Di­a­betes Lead­er­ship Coun­cil — are su­ing the HHS over what they see as its de­ci­sion to side with in­sur­ers and PBMs, hit­ting pa­tients’ pock­et­books when drug­mak­ers’ co­pay coupons should be help­ing.

The HHS pro­posed a rule in 2020 re­lat­ed to cer­tain co­pay ac­cu­mu­la­tor ad­just­ment pro­grams, which are cre­at­ed by pay­ers to pre­vent phar­ma-spon­sored co­pay as­sis­tance from be­ing count­ed to­wards a pa­tient’s de­ductible or out-of-pock­et max­i­mum.
