Appeals court quashes Sanofi’s big win on bellwether hair loss case
Sanofi thought it had emerged victorious from the first case of thousands to go to trial over its chemotherapy drug Taxotere — but on Thursday, a federal appeals court overturned that jury verdict, ordering a retrial and turning some heat on the pharma giant.
This particular lawsuit was filed back in 2016 by Barbara Earnest, a breast cancer survivor who was treated with several rounds of chemotherapy after her lumpectomy, including Sanofi’s Taxotere. While the treatments proved successful — Earnest was declared cancer-free — her hair never grew back.
