Ap­peals court quash­es Sanofi’s big win on bell­wether hair loss case

Sanofi thought it had emerged vic­to­ri­ous from the first case of thou­sands to go to tri­al over its chemother­a­py drug Tax­otere — but on Thurs­day, a fed­er­al ap­peals court over­turned that ju­ry ver­dict, or­der­ing a re­tri­al and turn­ing some heat on the phar­ma gi­ant.

This par­tic­u­lar law­suit was filed back in 2016 by Bar­bara Earnest, a breast can­cer sur­vivor who was treat­ed with sev­er­al rounds of chemother­a­py af­ter her lumpec­to­my, in­clud­ing Sanofi’s Tax­otere. While the treat­ments proved suc­cess­ful — Earnest was de­clared can­cer-free — her hair nev­er grew back.
