DOJ and Danco tell SCOTUS: Act now on abortion pill as court rulings provide 'untenable limbo'
The Department of Justice and Danco Laboratories on Friday sent emergency appeals to the Supreme Court asking to keep the status quo around the abortion pill mifepristone as conflicting court rulings, one of which is expected to take effect tomorrow morning at 1 AM, could irreparably harm women, the healthcare system, the pharma industry and more.
The appeal to SCOTUS follows the Fifth Circuit Court of Appeals ruling late Wednesday night that mifepristone should remain on the market, at least temporarily, although changes made by the FDA in 2016 to mifepristone’s REMS and later to loosen the restrictions on mail orders of the drug should be thrown out in the interim.
