DOJ and Dan­co tell SCO­TUS: Act now on abor­tion pill as court rul­ings pro­vide 'un­ten­able lim­bo'

The De­part­ment of Jus­tice and Dan­co Lab­o­ra­to­ries on Fri­day sent emer­gency ap­peals to the Supreme Court ask­ing to keep the sta­tus quo around the abor­tion pill mifepri­s­tone as con­flict­ing court rul­ings, one of which is ex­pect­ed to take ef­fect to­mor­row morn­ing at 1 AM, could ir­repara­bly harm women, the health­care sys­tem, the phar­ma in­dus­try and more.

The ap­peal to SCO­TUS fol­lows the Fifth Cir­cuit Court of Ap­peals rul­ing late Wednes­day night that mifepri­s­tone should re­main on the mar­ket, at least tem­porar­i­ly, al­though changes made by the FDA in 2016 to mifepri­s­tone’s REMS and lat­er to loosen the re­stric­tions on mail or­ders of the drug should be thrown out in the in­ter­im.
