DOJ turns to SCO­TUS ap­peal to keep abor­tion pill on the mar­ket

Fol­low­ing the or­der last night from the Fifth Cir­cuit Court of Ap­peals, At­tor­ney Gen­er­al Mer­rick Gar­land said Thurs­day that the De­part­ment of Jus­tice will try to take the case to the Supreme Court.

The move fol­lows the ap­peals court’s de­ci­sion to ef­fec­tive­ly al­low the preterm birth drug mifepri­s­tone to re­main on the mar­ket, at least tem­porar­i­ly, but with­out changes made by the FDA in 2016 to mifepri­s­tone’s REMS and lat­er to loosen the re­stric­tions on mail or­ders of the drug may be thrown out in the in­ter­im.
