FDA to SCO­TUS: Set­ting the mifepri­s­tone reg­u­la­tions clock back to 2016 is 'un­jus­ti­fied'

US So­lic­i­tor Gen­er­al Eliz­a­beth Prel­og­ar has called on the Supreme Court to over­turn an ap­peals court’s de­ci­sion from Au­gust that would roll back some of the reg­u­la­tions around the abor­tion drug mifepri­s­tone.

Writ­ing on be­half of the FDA just be­fore the Thanks­giv­ing hol­i­day, Prel­og­ar ar­gued that the phar­ma in­dus­try “has warned that the court’s le­gal hold­ings would ‘up­end’ a ‘set­tled reg­u­la­to­ry scheme’ and ‘sti­fle phar­ma­ceu­ti­cal in­no­va­tion'” as it would es­sen­tial­ly rep­re­sent a court over­rul­ing the FDA, and bring “out­dat­ed dos­ing and con­di­tions that FDA has now de­ter­mined are un­jus­ti­fied.”
