Federal appeals court rules in favor of Arkansas in PhRMA's suit over 340B expansion
In a win for Arkansas and the federal drug discount program known as 340B, a federal appeals court said the state can block pharma companies from limiting the availability of discounted drugs at certain pharmacies in a lawsuit brought by the lobbying group PhRMA.
PhRMA sued Arkansas’ Insurance Department Commissioner Alan McClain over a 2021 law that prohibited manufacturers from limiting hospitals and others’ ability to contract with outside pharmacies, calling it unconstitutional.
