Fed­er­al ap­peals court rules in fa­vor of Arkansas in PhRMA's suit over 340B ex­pan­sion

In a win for Arkansas and the fed­er­al drug dis­count pro­gram known as 340B, a fed­er­al ap­peals court said the state can block phar­ma com­pa­nies from lim­it­ing the avail­abil­i­ty of dis­count­ed drugs at cer­tain phar­ma­cies in a law­suit brought by the lob­by­ing group PhRMA.

PhRMA sued Arkansas’ In­sur­ance De­part­ment Com­mis­sion­er Alan Mc­Clain over a 2021 law that pro­hib­it­ed man­u­fac­tur­ers from lim­it­ing hos­pi­tals and oth­ers’ abil­i­ty to con­tract with out­side phar­ma­cies, call­ing it un­con­sti­tu­tion­al.
