Flori­da sues FDA again over Cana­di­an drug im­port plan

Flori­da sued the FDA to again try and launch its plan to im­port cer­tain pre­scrip­tion drugs from Cana­da.

The suit, filed in Flori­da dis­trict court last Fri­day, is an at­tempt to com­pel FDA to re­spond to an up­dat­ed FOIA re­quest from Flori­da’s Agency for Health Care Ad­min­is­tra­tion, or AH­CA.

Ac­cord­ing to the com­plaint filed by Flori­da At­tor­ney Gen­er­al Ash­ley Moody, the AH­CA filed a FOIA re­quest last month, ask­ing FDA for doc­u­ments re­lat­ed to cer­tain pro­pos­als sub­mit­ted by Flori­da and oth­er states re­gard­ing drug im­por­ta­tion plans. The re­quest is al­most iden­ti­cal to a pre­vi­ous one filed last year, but with an ex­pand­ed time­line to cov­er ma­te­ri­als that came out af­ter the 2022 FOIA.
