Mer­ck asks fed­er­al court for sum­ma­ry judg­ment in IRA case

Mer­ck asked a fed­er­al court Tues­day to is­sue a de­ci­sion on its In­fla­tion Re­duc­tion Act case with­out go­ing to tri­al — the lat­est step in the com­pa­ny’s at­tempt to chal­lenge the con­sti­tu­tion­al­i­ty of the new law that al­lows the US to ne­go­ti­ate drug prices.

The 59-page doc­u­ment, filed Tues­day, asks the US Dis­trict Court for the Dis­trict of Co­lum­bia for a sum­ma­ry judg­ment in its case against the gov­ern­ment. Last month, Mer­ck sued the US gov­ern­ment, say­ing the In­fla­tion Re­duc­tion Act vi­o­lates the First and Fifth Amend­ments be­cause it forces com­pa­nies to give dis­counts on their drugs with­out a choice.
