Merck asks federal court for summary judgment in IRA case
Merck asked a federal court Tuesday to issue a decision on its Inflation Reduction Act case without going to trial — the latest step in the company’s attempt to challenge the constitutionality of the new law that allows the US to negotiate drug prices.
The 59-page document, filed Tuesday, asks the US District Court for the District of Columbia for a summary judgment in its case against the government. Last month, Merck sued the US government, saying the Inflation Reduction Act violates the First and Fifth Amendments because it forces companies to give discounts on their drugs without a choice.
