PhRMA urges court to stop gov­ern­ment drug price ne­go­ti­a­tions be­fore they start

In­dus­try group PhRMA yes­ter­day asked a Texas dis­trict court to halt CMS’ in­com­ing drug price ne­go­ti­a­tions be­fore they kick off in earnest next month.

The fil­ing is just the lat­est in a bar­rage of law­suits — from Mer­ck and Bris­tol My­ers Squibb to Janssen and Astel­las — tar­get­ing Pres­i­dent Biden’s sig­na­ture In­fla­tion Re­duc­tion Act, which in ad­di­tion to the new ne­go­ti­at­ing pow­er for CMS al­so in­cludes a max­i­mum out-of-pock­et cap of $2,000 start­ing in 2025 for se­niors on Medicare, and a cap on in­sulin costs at $35 per month, as well as new re­bates for drug prices that rise faster than the rate of in­fla­tion.
