US Cham­ber of Com­merce files sec­ond suit over Medicare's in­com­ing drug price ne­go­ti­a­tions

The US Cham­ber of Com­merce late Fri­day sued HHS over the up­com­ing im­ple­men­ta­tion of drug price ne­go­ti­a­tions un­der the In­fla­tion Re­duc­tion Act.

This is the sec­ond suit over Medicare’s in­com­ing price ne­go­ti­a­tions in just the last week, as Mer­ck al­so filed in the US Dis­trict Court for the Dis­trict of Co­lum­bia, claim­ing the IRA vi­o­lates the First and Fifth Amend­ments. The Cham­ber of Com­merce al­so points to First Amend­ment is­sues with the IRA’s com­pelled-speech pro­vi­sions, and says the ne­go­ti­a­tion process lead­ing to the low­er prices is a sham be­cause the end re­sult is gov­ern­ment-im­posed price con­trols.
