US Chamber of Commerce files second suit over Medicare's incoming drug price negotiations
The US Chamber of Commerce late Friday sued HHS over the upcoming implementation of drug price negotiations under the Inflation Reduction Act.
This is the second suit over Medicare’s incoming price negotiations in just the last week, as Merck also filed in the US District Court for the District of Columbia, claiming the IRA violates the First and Fifth Amendments. The Chamber of Commerce also points to First Amendment issues with the IRA’s compelled-speech provisions, and says the negotiation process leading to the lower prices is a sham because the end result is government-imposed price controls.
