US Patent and Trade­mark Of­fice to hear patent chal­lenge over ex­per­i­men­tal seizure treat­ment

The US Patent and Trade­mark Of­fice (USP­TO) is tak­ing a sec­ond look at a patent it grant­ed Ovid Ther­a­peu­tics around meth­ods for treat­ing seizures fol­low­ing a chal­lenge from Mar­i­nus.

The USP­TO’s Patent Tri­al and Ap­peal Board grant­ed Mar­i­nus’ pe­ti­tion seek­ing post-grant re­view of Ovid’s Patent No. 11,395,817, al­so known as the ‘817 patent. It cov­ers “meth­ods and com­po­si­tions” for treat­ing epilep­tic dis­or­ders, in­clud­ing a dif­fi­cult-to-treat con­di­tion called sta­tus epilep­ti­cus (SE).
