Fed­er­al judge de­nies Cham­ber of Com­merce's ef­fort to block IRA's Medicare drug price ne­go­ti­a­tion pro­vi­sions

A fed­er­al judge on Fri­day up­held the Medicare drug price ne­go­ti­a­tion pro­vi­sions of the In­fla­tion Re­duc­tion Act, block­ing an ef­fort by the Cham­ber of Com­merce to stop the ne­go­ti­a­tion process­es be­fore they start.

The judge’s de­ci­sion came in re­sponse to a law­suit filed by the Cham­ber of Com­merce in an Ohio dis­trict court in June that ar­gued the IRA vi­o­lates the First Amend­ment and will re­sult in gov­ern­ment price con­trols on those drugs. Trump-ap­point­ed Judge Michael New­man of the South­ern Dis­trict of Ohio de­nied the Cham­ber’s re­quest for a pre­lim­i­nary in­junc­tion but he did not dis­miss the case as re­quest­ed by the Biden ad­min­is­tra­tion.
