Fed­er­al judge rules against Mod­er­na in vac­cine IP suit

A fed­er­al judge ruled against Mod­er­na in a case al­leg­ing that the vac­cine mak­er in­fringed on Al­ny­lam’s patent for biodegrad­able lipids, which are used in Mod­er­na’s Covid-19 vac­cine.

Mod­er­na had ar­gued that Al­ny­lam’s claims need to be tak­en up against the fed­er­al gov­ern­ment, which was the sole pur­chas­er of the com­pa­ny’s vac­cine in the US.

Delaware dis­trict court judge Colm Con­nol­ly on Wednes­day ruled against Mod­er­na’s par­tial mo­tion, which sought to dis­miss claims from Al­ny­lam, the plain­tiff in this law­suit, re­gard­ing Mod­er­na’s sales of its Covid-19 vac­cine to the US gov­ern­ment.
